Texas made delta-8 a felony, and the federal hemp ban is next
A gummy that was legal last year can now mean a felony charge in Texas. And two federal deadlines this fall could make most hemp THC products unlawful in every state.
What Texas banned
On July 31, Texas began enforcing a ban on most hemp-derived THC products: delta-8, delta-10, THCP and THCA flower. They're now treated as Schedule I substances, the same legal category as heroin. It wasn't a new law. The state health department reinstated a 2021 rule.
Selling is illegal, and cannabis attorneys say possession can be charged as a state jail felony: 180 days to two years and up to $10,000 in fines.
How we got here
The 2018 federal Farm Bill legalized hemp, meaning cannabis under 0.3% delta-9 THC, and Texas followed in 2019. That definition left a loophole: chemists turned legal hemp CBD into intoxicating delta-8, and THCA flower tested under the limit until it was lit. Texas grew to roughly 14,000 licensed shops.
The state first tried to ban delta-8 in 2021. A company called Hometown Hero sued, and a court order protected the industry for almost five years. In 2025 the legislature passed a total THC ban, and Governor Greg Abbott vetoed it, arguing for regulation instead of prohibition. Then in May 2026 the Texas Supreme Court ended the old court order and ruled the health department had the power to ban these products all along. Two months later, enforcement began.
What's still legal in Texas
- Still sold: delta-9 products under 0.3% by dry weight (most hemp gummies and the THC drinks in liquor stores), and plain CBD.
- Gone: every vape containing any cannabinoid, even CBD, under a separate law.
- In limbo: smokable hemp. It was banned March 31, blocked by a judge in April and unblocked in June.
The court fight
Three major lawsuits argue the federal Farm Bill protects these products and that Texas is blocking interstate commerce. So far the industry has won zero injunctions: a federal judge in Galveston refused an emergency order in August, and a Travis County court wouldn't pause the ban either. The industry's lead attorney, Andrea Steel, says losing at this stage doesn't decide the case. The next hearing is October 30 in Travis County.
The federal hemp ban: two waves
Section 781 of last year's federal spending bill rewrote the legal definition of hemp nationwide.
November 12: cannabinoids the plant can't produce naturally, such as THC-O, lose federal hemp status in all 50 states.
December 11: a total-THC standard with a cap of 0.4 mg per container, plus natural cannabinoids made in a lab, which most likely includes delta-8 made from CBD, though that depends on an FDA list of natural cannabinoids that still isn't out. Popular hemp drinks and gummies typically contain 2 to 10 mg or more.
Industry lawyers estimate that would make about 95% of hemp cannabinoid products federally unlawful, including THC drinks, gummies and THCA flower. Bills to soften the change are in Congress, but none had passed when this episode aired.
Around the states
- Massachusetts: Question 8 on November 3 would end recreational marijuana sales.
- Ohio: federal judges have blocked the state's attempt to push hemp products into licensed marijuana stores three times.
- Idaho: a November ballot measure would stop citizens from ever legalizing cannabis by initiative.
- Tennessee: lawmakers from both parties pushed back on state police at a medical cannabis hearing.
- Minnesota: a bill to cap THC in flower at 15% is dead.
- Also: Michigan school warning notices, Connecticut's medical-first rule for new products, Maryland's potency-testing pilot, and New York's approval of the first U.S. clinical trial of a prescription THC medicine for chronic pain.
What it means for you
- Use delta-8, delta-10 or THCA flower? Check your state's law before you buy. In Texas it can be a felony.
- Buy hemp THC drinks or gummies? The December 11 cap could pull most of them nationwide unless Congress acts.
- Run a shop? November 12 and December 11 are your dates. Talk to a cannabis attorney now.
- Vote in Massachusetts or Idaho? Cannabis is on your ballot November 3.

Correction: the episode said the federal push to reschedule marijuana still hadn't happened. In April 2026 the government did move state-licensed medical marijuana to Schedule III; everything else remains Schedule I. Episode 2 has the full story →
Update (Oct 13, 2026): the episode says delta-8 loses federal hemp status on November 12. After Congress's September 2026 stopgap, only cannabinoids the plant can't make naturally (like THC-O) keep that date; legal analyses place delta-8 made from CBD with the December 11 changes, pending an FDA list. This article reflects the update.
